Terms of Service

These Terms of Service ("Terms") govern your access to and use of Enlistr - including the website at enlistr.net, all sub-pages, mobile apps, and APIs (the "Service") operated by Enlistr Ltd. ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract.

2. Accounts

• You're responsible for safeguarding your sign-in credentials.
• You may not create multiple accounts to evade restrictions, suspensions, or fees.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3. Listings and content

Enlistr is a neutral marketplace that connects independent creators - hosts, organisers, tour operators, and service providers - with the people who book them. Every listing is created, priced, described, and controlled by the person or business that publishes it. Enlistr is not the creator, owner, agent, or operator of any listing, and is not a party to the booking agreement between a creator and a customer.

• You retain ownership of content you upload (photos, descriptions, reviews).
• You grant Enlistr a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your content for the operation and promotion of the Service.
• As the creator of a listing you are solely responsible and liable for it - its accuracy, pricing, availability, safety, and your legal authority (including any permits or licences) to offer it. Liability for a listing, and for what happens under a booking, sits with its creator, not with Enlistr.
• Listings must comply with local laws on short-term rentals, events, tours, taxes, and consumer protection.
• Prohibited content includes anything that infringes IP, promotes hate or violence, exploits minors, or facilitates illegal activity.
• Enlistr is a verified, community-based marketplace: listings are open to the community and can be reported at any time. See our Community Guidelines and Trust & Safety page.

4. Bookings and payments

• Enlistr facilitates payments between guests and hosts through Stripe. Card data is captured by Stripe Elements; we never see raw card numbers.
• Hosts agree to honour confirmed bookings and to provide the listing as advertised.
• Guests agree to pay the total shown at checkout, including taxes and service fees.
• Refunds and cancellations follow each listing's published policy and our platform-level safety nets (no-show, host cancellation, dispute resolution).
• Disputes are reviewed by our trust-and-safety team. Where a chargeback is filed, the parties authorise us to share booking metadata with the payment processor.

5. Fees

Enlistr charges a service fee on each booking and a payment-processing fee. Current rates are shown at checkout and on your dashboard. We reserve the right to adjust fees with at least 30 days' notice.

6. KYC and verification

To list paid offerings or receive payouts you must complete identity verification. We may request government ID, proof of address, and business registration. Information collected is used solely for compliance and is handled per our Privacy Policy.

7. Acceptable use

• No scraping, automated mass requests, reverse-engineering, or attempts to bypass rate limits.
• No use of the Service to send spam or unsolicited marketing.
• No interference with other users' bookings or the platform's integrity.
• No collection of personal data of other users beyond what is necessary for an active booking.

8. Reviews

Reviews must be based on a genuine first-hand experience. Manipulating reviews - your own or others' - is grounds for removal and account suspension.

9. Termination

You may close your account at any time from Settings → Privacy. We may suspend or terminate accounts for breach of these Terms, fraud, abuse, or risk to other users. We will refund any prepaid fees that cover periods after termination, less amounts owed.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Enlistr disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Listings are offered by independent creators, not by Enlistr, and Enlistr is not their agent. Enlistr does not independently inspect, verify, endorse, or guarantee any listing. Trust on Enlistr is community-based: listings are open to the community, can be reported at any time, and a listing that draws credible reports is reviewed and removed quickly so bad actors are weeded out. You are responsible for using your own judgement before you book, and creators are responsible for what they offer.

11. Limitation of liability

To the extent permitted by law, Enlistr's aggregate liability for claims arising from your use of the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages.

12. Indemnity

Because you alone control your listings and your conduct, you agree to indemnify and hold Enlistr harmless from any claim, loss, or liability arising out of your listings, your bookings, your conduct on the Service, or your breach of these Terms - including claims brought by the people who book you or by third parties affected by your listing.

13. Governing law

These Terms are governed by the laws of Jamaica. Disputes will be resolved in the courts of Kingston unless required otherwise by your local consumer-protection law.

14. Changes

We will notify registered users of material changes by email at least 14 days before they take effect. Continued use after the effective date is acceptance.
